3.6 Drained weight: The minimum drained weight of the pitted red maraschino cherries shall be not less than the following:

The drained weight of the pitted red maraschino cherries shall be determined by emptying the contents of the container on an 8-inch or 12-inch diameter U.S. Standard No. 8 sieve, allowing the sieve the drain for 2 minutes in an inclined position at a 17^O to 20^O angle, and calculating the weight of the cherries by subtracting the weight of the dry sieve.

3.7 Age requirement. Unless otherwise specified in solicitation contract, or purchase order, the pitted red maraschino shall be prepared from the latest year crop, and shall be processed and packaged less than one year prior to purchase by the Government.

4. REGULATORY REQUIREMENTS.

3.1 The delivered pitted red maraschino cherries shall comply with all applicable Federal, State, and local mandatory requirements and regulations relating to the preparation, packaging, labeling, storage, distribution, and sale of the pitted red maraschino cherries shall conform in every respect to the provisions of the Federal Food, Drug, and Cosmetic Act and regulations promulgated thereunder.

4. QUALITY ASSURANCE PROVISIONS.

4.1 Product conformance. The pitted red maraschino cherries provided shall meet the salient characteristics of this CID, conform to the producer’s own specifications, standards, and quality assurance practices, and be the same pitted red maraschino cherries offered for sale in the commercial market. The Government reserves the right to require proof of such conformance.

4.2 Quality assurance. When required in the solicitation, contract, or purchase order that product quality or acceptability or both be determined, the Processed Products Branch (PPB), Fruit and Vegetable Programs, Agricultural Marketing Service, U.S. Department of Agriculture shall be the certifying activity and shall make the determination in accordance with applicable PPB procedures. The pitted red maraschino cherries shall be examined or analyzed or both in accordance with applicable provisions in the CID, solicitation, contract, or purchase order, and, when applicable, the United States Standards for Condition of Food Containers in effect on the date of the solicitation.
